t has been over 40 years since Congress initially passed the Family Educational Rights and Privacy Act (“FERPA”) (20 U.S.C. § 1232g), also referred to as the “Buckley Amendment” after its primary Congressional sponsor. Needless to say, since the 1974 enactment of FERPA there have been substantial changes in the manner in which schools, colleges and universities collect, maintain and use student information, with such changes notlimited to the switch from primarily paper files to electronic databases.
